1. Overview

These Terms of Service ("Terms") govern your use of getlioness.com and all related content, features, tools, products, and services (the "Services"). Smartbod Inc., doing business as Lioness ("Lioness," "we," "us," or "our"), operates the Services. The Services are powered by Shopify.

These Terms include important information about your legal rights, including warranty disclaimers and limitations of liability. By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Services.

2. Eligibility and your account

You must be at least 18 years old to use the Services or buy our products. By using the Services, you confirm that you're 18 or older.

You agree to provide information that is correct, current, and complete, including your email address and your billing, payment, and shipping information. You're responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, or assign your account to anyone else.

3. Our products

We try to describe and display our products accurately. Colors and product appearance can vary depending on your device and screen settings. We may change product descriptions, discontinue products, or limit quantities at any time.

4. Not medical advice

Lioness is a personal wellness product. It isn't a medical device, and it isn't intended to diagnose, treat, cure, or prevent any disease or condition. The data and insights in the Lioness app are for personal and educational use only.

Nothing in the Services is medical advice. If you have a medical condition, are pregnant, or have concerns about your health, talk to a healthcare provider before you use Lioness.

5. Safe use

Use Lioness only as described in the included instruction manual. Stop using the device if you feel discomfort or irritation. Use only water-based products with Lioness.

6. Orders

When you place an order, you make an offer to buy. We may accept or decline any order for any reason. Your order isn't accepted until we confirm it, and we must receive your payment first. Review your order carefully before you submit it. We may not be able to cancel an order after we've accepted it. If we decline, change, or cancel your order, we'll try to contact you using the information you gave us.

You confirm that your purchases are for your own personal use and not for resale or export.

Returns, refunds, and warranty claims are covered by our Refund Policy, which is part of these Terms.

7. Prices and billing

Prices, discounts, and promotions can change without notice. You pay the price in effect when you place your order, as shown in your order confirmation email. Unless stated otherwise, prices don't include taxes, shipping, customs, or import charges. For international orders, you're responsible for customs fees, duties, and taxes.

Promotions may have their own terms. If a promotion's terms conflict with these Terms, the promotion's terms apply.

You confirm that your payment information is accurate, that you're authorized to use your payment method, and that you'll pay all charges at the posted prices, including shipping and applicable taxes.

8. Shipping and delivery

We ship in discreet packaging. Delivery times are estimates and aren't guaranteed. We're not responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when we hand your order to the carrier.

9. Errors and omissions

The Services may occasionally contain errors in product descriptions, pricing, promotions, shipping charges, or availability. We may correct errors, update information, or cancel orders at any time without notice, including after you submit an order.

10. The Lioness app and your privacy

The Lioness app may have its own terms, which apply when you use the app.

Our Privacy Policy explains how we collect, use, and protect your personal information, and it's part of these Terms. Because Shopify hosts the Services, Shopify also collects and processes personal information about your use of the Services. Information you submit may be shared with Shopify and with third parties, some located outside your country, so that we can provide the Services. Some personal information may be subject to Shopify's Privacy Policy.

11. Intellectual property

The Services and their content, including trademarks, text, images, graphics, product reviews, video, and audio, belong to Smartbod Inc., its affiliates, or its licensors. They're protected by US and international intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, republish, or create derivative works from any content without our written permission. "Lioness" and the Lioness logo are trademarks of Smartbod Inc. Shopify's name and marks are trademarks of Shopify. Other marks belong to their respective owners.

12. Reviews and feedback

If you submit reviews, ideas, suggestions, or other content ("Feedback"), you give us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display it in any medium for any purpose, including marketing.

You confirm that you own or have the rights to your Feedback, that you've disclosed any compensation or incentive you received for it, and that it doesn't violate anyone's rights. You may not use a false email address or pretend to be someone else. We don't have to keep Feedback confidential, pay for it, or respond to it. We may remove any Feedback that we consider unlawful or objectionable.

13. Third-party tools and links

The Services may include tools, content, or links from third parties. We don't control them and provide them "as is." Your use of third-party tools or websites is at your own risk and is subject to their terms.

14. Relationship with Shopify

Lioness is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Smartbod Inc. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Smartbod Inc., including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Smartbod Inc.

15. Prohibited uses

You may use the Services for lawful purposes only. You agree not to:

  • Use the Services for any unlawful or malicious purpose, or to violate any law
  • Infringe our intellectual property or anyone else's
  • Harass, abuse, defame, or harm our employees or anyone else
  • Send false or misleading information, spam, or unsolicited advertising
  • Impersonate any person or entity
  • Upload viruses or other malicious code
  • Collect or track other people's personal information
  • Use robots, scrapers, AI tools, or other automated means to access the Services
  • Bypass our security measures or access restrictions
  • Resell or commercially exploit any part of the Services

We may suspend or terminate your account without notice if you violate these Terms.

16. Automated agents

This section applies if you use software that acts on your behalf without direct supervision (an "Agent") to access the Services. An Agent must identify itself in every request by including "Agent/[agent name]" in its user agent string. It must not hide that it's an Agent, mimic human behavior, get around CAPTCHAs, or evade any measure we use to limit Agent access. It must answer truthfully if asked whether it's a human. We may limit or block Agent access at any time.

17. Termination

We may end your access to the Services at any time, at our discretion, without notice. You remain responsible for all amounts due up to the date of termination. Sections that by their nature should survive termination continue to apply, including intellectual property, feedback, disclaimers, limitation of liability, indemnification, and governing law.

18. Disclaimer of warranties

INFORMATION IN THE SERVICES IS PROVIDED FOR GENERAL INFORMATION ONLY. EXCEPT FOR THE LIMITED WARRANTY IN OUR REFUND POLICY, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DON'T ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

19. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SMARTBOD INC., SHOPIFY, AND THEIR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES LOST PROFITS, LOST DATA, AND REPLACEMENT COSTS ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

20. Indemnification

You agree to indemnify, defend, and hold harmless Smartbod Inc., Shopify, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, losses, or expenses, including reasonable attorneys' fees, arising from:

  • Your breach of these Terms
  • Your violation of any law or anyone else's rights
  • Your use of the Services

We'll notify you of any such claim. We may control the defense and settlement of the claim at your expense. We won't settle a claim that requires you to do anything other than pay money without your consent, and we won't unreasonably withhold that request. You agree to cooperate in the defense.

21. Governing law

California law governs these Terms, without regard to conflict-of-law rules. You agree that any dispute is resolved in the state or federal courts located in Alameda County, California, and you consent to their jurisdiction.

22. General terms

  • Severability. If any part of these Terms is unenforceable, it's enforced to the fullest extent permitted, and the rest of the Terms stay in effect.
  • Waiver. If we don't enforce a right, we haven't waived it.
  • Entire agreement. These Terms and the policies they reference are the entire agreement between you and us about the Services. They replace any prior agreements.
  • Assignment. You may not transfer these Terms without our written consent. We may transfer them without notice to you.
  • Headings. Headings are for convenience only and don't affect how these Terms are read.

23. Changes to these Terms

We may update these Terms at any time by posting changes on this page. We'll notify you of material changes as required by law. If you keep using the Services after we post changes, you accept the updated Terms.
